I wonder if this town has a problem with something like a state fair / circus with carnies running games to win a stuffed animal? That is not frowned upon and usually perfectly acceptable. Are they really that different? You pay money to play a game, yet there are so many places that just won't allow a museum or even an arcade, sigh....

there are dozens of by-laws in towns that are no longer valid and/or enforced.  The big deal here is that they decided to enforce it after a period of time.  I smell something weird her

Usually once you make an application to change the law (i.e. landuse), they allow you to continue your use until a final decision has been made (assuming no one is being harmed).  Once the decision has been made, then enforcement begins.... perhaps it is different there?



Government/society keep adding new laws ... but rarely take any away...  This we are becoming more restrictive all the time - until we're micro managed.  - wasn't there a Sci-Fi story about this???  




There was a really good write-up on this arcade in a recent issue of Gamesroom Magazine (one of the best hobbiest magazines out there - along with PinGame Journal - in case you didn't know.)

That's not true. Old laws are repealed all the time. You just never hear about it because it's not newsworthy. The repealed laws are usually so outdated or inapplicable that nobody cares and the motion to repeal passes without issue or debate. Look at legislation passing through the House of Commons on any given day and you'll see sections of laws and even entire laws being repealed all over the place.

The by-law in the town in the story clearly should have been knocked off the books a long time ago.

Would they have the option of not enforcing the law and letting this guy continue until they were able to change it? It would appear they want to follow through a process which takes time and don't seem to see this guy as being a problem other than being in violation of an old and likely inappropriate for the time law. They could be getting pressured from a disgruntled neighbour or someone with a reason to go after this individual and trying to have the law enforced.

If a law is in place, is there an obligation to enforce it?

You would not believe the many arcane laws that still exist on the books (in Canada and the US). A friend of mine is a lawyer with the government who spends a fair amount of her time trying to get old laws like this off the books. Quite frequently some obscure lawslike this causes issues (but they usually affect such a small niche market or area that you rarely hear about them unless it's a slow news day). Property laws in particular stemming from the 1800's can cause hugh issues for people. Often they are overlooked because nobody remembers tham let alone enforce them. the problem as mentioned in the article is it take as much time to amend or revoke an old trivial and arcane law as it does an important one - which given our current government is probably a good thing.

Very sad. That looked like a great place. I spent the afternoon at "Midway" with my son in Ottawa. Yikes - what a difference compared to the old arcades of my youth. Kids playing crap ticket games  just to win crap prizes that you can get at the dollar store. Not a single pin! Went to "boomers", Chucky Cheeze and another games place when I was in Florida last week - same noizy crap - Feels empty. I would pay $10.00 an hour to visit a retro-arcade in a flash.

The only pinball machine I saw in 2 weeks in Florida was a "Popeye" in the GAP store at that big outlet mall in Ft. Lauderdale - and it was broken. I turned it on and one of the clerks (young girl) asked me how I did that as she had been trying to figure it out for weeks. (sigh) If I hadn't flown to Florida I probably would have offered her $50.00 for it.

Pins are just way to hard to maintain for an operator given their earnings ratio if kids (and their parents) keep playing these crappy ticket dispensing monstrosities. Sheesh, put in your token and hope the truck tips - 1.5 seconds of anticipation (25c) for usually 1 - 3 tickets valued at about 2c each.

The clothesline bylaw in Kanata was real, but has since been repealed.  The eco/green movement took care of that.
